PROGRAM
The Unitary Patent System (UPS) and the Unified Patent Court (UPC) will come into effect in early 2017 if current predictions are accurate. This will represent the biggest change in patent legislation in Europe for almost 40 years since the European Patent Office came into being. It will have potentially profound consequences for existing, as well as future, patent rights. Managers of patent portfolios need to be aware of the new legislation and be in a position to take action in the "sunrise period" before the UPC comes into being, which is due for mid-2016. This means understanding the consequences of the legislation on patent budgets and developing a patent filing and defense strategy that addresses the changes and does not react to them.
