The presentation by Brian Howard, Lex Machina, will look at quantitative changes in patent litigation over the last few years, focusing on:

  • Which courts are seeing more cases post decision, which courts are seeing fewer
  • The impact of the influx of cases on judicial efficiency and the use of judges from other districts
  • Transfer motion success rates
  • Other recent trends in patent lit including top parties and firms, findings and damages

Presenter:
As Lex Machina's Associate General Counsel and Legal Data Scientist, Brian Howard is responsible for authoring reports showcasing various areas of Lex Machina data, and for providing advanced analytics on Lex Machina data to answer complex questions posed by customers, press, and academics. Brian came to Lex Machina from the Durie Tangri law firm in San Francisco, where he defended and advised a variety of clients accused of infringing software patents (and occasionally worked copyright or trademark advice matters). Previously, Brian worked at Quinn Emanuel, where he was on the team handling the Apple/HTC/Motorola/Samsung patent litigation. Brian attended the University of Virginia Law School, graduating in 2009 with a J.D. and a M.A. in Legal History. Prior to law school, Brian was on the faculty of the Thomas Jefferson School of St. Louis, Missouri, teaching Precalculus and Ancient and European History, and serving as the school's Director of Technology. Brian earned his bachelor's degree from Yale University in 2004 in History and Computer Science.
